Landlord Gas Safety: What Scottish Law Requires

If you rent out property anywhere in Scotland — a single flat or a portfolio of HMOs — gas safety is one of the areas where the law gives no room for error. The rules are set out under the Gas Safety (Installation and Use) Regulations 1998, and enforcement in Scotland has been tightening in recent years. Here's what you actually need to have in place.

An annual gas safety check, by a Gas Safe registered engineer

Every gas appliance and flue that you as landlord are responsible for must be checked for safety every 12 months, by an engineer who is Gas Safe registered — the only legal body permitted to carry out gas work in the UK. This isn't optional and isn't something a general handyman, however competent, can legally do.

A valid certificate, kept for at least 2 years

The engineer issues a Gas Safety Record (often still called a "CP12") after each check. You're legally required to keep copies of the last two records. If you sell the property or transfer management to another landlord or agent, these records should be handed over.

A copy to tenants — within strict timeframes

Existing tenants must receive a copy of the current gas safety record within 28 days of the check being carried out. New tenants must receive a copy before they move in. Missing either of these deadlines is a breach even if the check itself was done on time.

What happens if you don't comply

Non-compliance can result in prosecution, unlimited fines, and in serious cases imprisonment. Beyond the legal risk, an invalid or missing gas safety certificate can also invalidate landlord insurance, and in Scotland can affect your ability to serve certain eviction notices. For HMO properties, evidence of a valid certificate is typically required as part of licence applications and renewals with the local council.
